1. Acceptance of Terms

By accessing and using the To-Deck web application ("Service"), operated by To-Deck ("we", "us", or "our"), you agree to be bound by these Terms of Service. If you disagree with any part of the terms, you may not access the Service. You must be at least 13 years of age (or 16 in the European Economic Area) to create an account and use the Service.

2. Description of Service

To-Deck is a free, cloud-synced productivity and task management tool. We reserve the right to modify, suspend, or discontinue the Service (or any part or content thereof) at any time with or without notice to you.

3. Accounts and Security

When you create an account, you must provide a username and password. You are solely responsible for safeguarding the password that you use to access the Service. We encourage the use of strong passwords. You agree not to disclose your password to any third party. We cannot and will not be liable for any loss or damage arising from your failure to comply with these security obligations.

You agree to use the Service only for lawful purposes. You must not:

The Service and its original content, features, design, and functionality are and will remain the exclusive property of To-Deck and its licensors. You retain full ownership of the data (tasks) you input into the Service.

Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. We expressly disclaim all warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free.

7. Limitation of Liability

In no event shall To-Deck, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.

8. Governing Law

These Terms shall be governed and construed in accordance with the laws of Italy, without regard to its conflict of law provisions. Any dispute arising from these Terms will be subject to the exclusive jurisdiction of the competent courts in Italy.

9. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
